1. Who we are and what these terms cover
Berry is a web app (PWA) and website for finding lost pets and keeping pets safe, provided by RH COMMODITIES SRL, a Romanian company with its registered office at I.C. Brătianu 3, 077045 Chitila, Ilfov, România, registration code (CUI) 25651780, Trade Register number J2009001332239 (Berry, we, us). Our full company details are on the Legal notice page.
These Terms and conditions, together with the Community guidelines, the Subscription and refund terms, the Privacy policy and the Cookie policy, form the agreement between you and Berry (the Agreement).
You accept the Agreement when you tick the acceptance box while setting up your account. Some parts of Berry can be used without an account (for example the map and public posts); in that case the Agreement applies as far as it is relevant.
2. What Berry is
Berry helps neighbours find each other when a pet goes missing or is found. With Berry you can, in particular:
- post lost (LOST) or found (FOUND) pet alerts and danger alerts (poisoned bait, aggressive dogs, broken glass, traps and so on);
- receive push notifications for alerts near the places you have saved (up to 3, each with its own radius);
- add sightings ("I saw it") to a lost-pet alert and talk to others through the in-app chat;
- create profiles for your pets, with a QR tag for the collar and a health booklet with reminders;
- read guides written by the Berry team, browse dog parks added by the community and a partners directory (vets, clinics, grooming, shops), with reviews.
Found-pet alerts, danger alerts, sightings, chat, notifications, the A4 poster, the share image and the alert's QR code are free. A lost-pet alert is free for a 2 km radius; the paid services are described in section 8.
3. Your account
To post, receive notifications or use the chat, you create an account with your email address. You sign in with a 6-digit code sent by email or with a passkey saved on your device.
- You must be at least 16 years old; by accepting the Agreement you confirm that you are. If you are under 18, you need the consent of a parent or guardian to buy paid services.
- An account belongs to one person. Do not create accounts on someone else's behalf, and do not use several accounts to get around limits or a block.
- You are responsible for keeping access to your email and to your passkey devices secure. Tell us straight away at support@qr-iva.com if you suspect someone else is using your account.
- Your default display name looks like "Vecin #1234" ("Neighbour" in Romanian). Your email address is never shown to other users.
4. What you can post
You may post only true content, about real situations, that you have the right to publish. In particular:
- an alert must concern a real animal that is lost, found or in danger, and the place marked on the map must be the real one (we recommend a nearby landmark rather than the exact address of your home);
- do not accuse or identify people (names, photos, number plates, addresses) in connection with a loss, theft or poisoning; report criminal acts to the Police (112);
- do not sell, buy, rehome for a fee or offer breeding through Berry;
- do not post false, duplicate or test alerts, or alerts used as advertising;
- do not harass, threaten or deceive other users, or ask them for money to return an animal.
The full rules are in the Community guidelines, which are part of the Agreement.
5. Your content and the licence you give us
The content you post (texts, photos, places on the map, sightings, reviews, parks, messages) remains yours. You grant us a non-exclusive, royalty-free, worldwide licence, for as long as the content is in Berry and for the time needed to delete it, to host, store, copy, technically adapt (for example resize photos), display and transmit it as needed to run Berry. For public alerts, the licence includes generating the poster, the share image and the alert's public link, which anyone may share further to help find the animal.
You confirm that you hold the rights needed for the content you post (for example, that the photos are yours or that you are allowed to use them). Photos are checked before they are published to make sure they contain no location metadata (EXIF).
6. Moderation, reporting and blocking
We do not check content before it is published and we have no general obligation to monitor it. Any user can report an alert, sighting, review, park or message in the app, and anyone (including without an account) can notify us of illegal content at support@qr-iva.com, as described in the Community guidelines.
When content breaches the Agreement or the law, we may hide or delete it, limit its visibility, or suspend or close the account, depending on how serious and how repeated the breach is. We tell you about the decision and the reasons for it, by email or in the app (as required by Article 17 of Regulation (EU) 2022/2065, the Digital Services Act), unless the law or the safety of others prevents us. You can contest the decision within 6 months by replying to our message or writing to support@qr-iva.com; a person on our team will review the case, as described in the Community guidelines.
The only automated tools we use for moderation are: hiding a danger alert automatically after enough "It's gone" votes from the community; limits on how often you can post or report, which protect against spam (for example, at most 5 alerts in 24 hours); and technical checks on uploaded photos (file type and location metadata). Every other decision, such as hiding content or blocking an account, is taken by a person on our team. New parks appear after approval. We apply these rules diligently, objectively and proportionately, with due regard to the rights and legitimate interests of everyone involved, including freedom of expression. Actions by our administrators are logged internally.
7. How we display and rank content
- The map and the Feed show active alerts, mainly by distance from you or from the chosen place and by how recent they are.
- Alerts with a Boost appear first in the Feed for the period included in the package and carry the Promoted badge.
- The partners directory includes only partners who pay to be listed; the order depends on category and distance. Sample partners are labelled "Example".
- Reviews (1–5 stars) can be left by any user with an account, one review per user for each partner or park, which can be edited. We do not check whether the author actually bought the partner's service. You cannot review your own business, and reported reviews are moderated. The average and the number of reviews include all visible reviews.
8. Paid services
- Boost 5 km – €4.99 (one-time payment, VAT included): 5 km radius, notifications at posting and after 24 h, first in the Feed for 7 days, alert active for 30 days.
- Boost Max 10 km – €9.99 (one-time payment, VAT included): 10 km radius, notifications at posting and after 12 h, 24 h and 72 h, first in the Feed for 14 days, alert active until you close it (up to 90 days).
- Protection subscription (monthly): Tier 1 (1 pet) €1.21, Tier 2 (2 pets) €2.42, Tier 3 (3–5 pets) €3.63 per month, VAT included (Romanian VAT of 21%; net prices €1, €2 and €3; if a different VAT rate applies to you, the app shows you the final price before you pay). It includes pet profiles, the QR tag, the health booklet with reminders and one free Boost 5 km per pet every 12 months. Up to 5 pets per account.
Repeat notifications from a Boost go only to neighbours who have not yet opened the alert and are no longer sent once the alert is closed. A Boost is applied only after the payment is confirmed. The trial, renewal, cancellation and refunds are described in the Subscription and refund terms, which are part of the Agreement.
9. Payment, prices and VAT
Payments are made through Stripe, in euro. You enter your card details directly with Stripe; we never see or store them. VAT is calculated automatically at checkout based on your country; the app shows final prices, VAT included. For every payment, Stripe sends you an electronic receipt by email; the subscription's invoices are also available in the Stripe billing portal.
We may change prices. A new price applies to your subscription only from a later renewal, and only if we told you at least 30 days in advance; if you do not agree, you can cancel before the renewal. The price of a Boost is the one shown when you buy it.
10. Right of withdrawal
As a consumer, you generally have the right to withdraw from a distance contract within 14 days without giving a reason (Romanian Government Emergency Ordinance No. 34/2014). For a Boost, which starts immediately at your request, the right of withdrawal is lost once the service has been fully performed. For the subscription, you can withdraw within 14 days of the contract being concluded (if you withdraw during the free trial, you pay nothing). To withdraw, send us a clear statement by email or use the model withdrawal form. Exactly how these rules apply, including proportional refunds and the model form, is explained in the Subscription and refund terms.
11. Partners and third-party services
The partners in the directory (vets, clinics, veterinary ambulances, grooming, shops) are independent businesses. Berry is not a party to contracts between you and a partner and is not responsible for their services, products, prices, opening hours or offers. Partner information is provided by the partners; check it with them directly, especially in an emergency.
Some features open services provided by other companies, such as the map apps (Apple Maps, Google Maps, Waze) for "Directions" or Stripe for payments. Their own terms apply to them.
12. Notifications, maps and availability
Push notifications depend on your browser, your operating system, the push services of Google, Apple, Mozilla or Microsoft and your device settings. We cannot guarantee that every notification arrives, arrives on time or is seen. Saved places are rounded to about 100 m, so at the edge of a radius a neighbour very close to the boundary may or may not be notified.
We work to keep Berry available at all times, but there may be interruptions for maintenance, updates, provider outages or attacks. We may add, change or remove features; if we significantly reduce a paid service you have already paid for, we will tell you and refund the unused part.
As a consumer, you also benefit from the legal guarantee of conformity for digital services (Romanian Government Emergency Ordinance No. 141/2021, which implements Directive (EU) 2019/770). If a paid service does not work as described, tell us at support@qr-iva.com: we will bring it into conformity free of charge within a reasonable time or, if that is not possible, reduce the price or refund you.
13. What we do not guarantee
- Berry does not guarantee that a pet will be found. Berry is a tool that helps the community; the outcome depends on many factors we do not control.
- Berry does not give veterinary advice. The health booklet, the vaccination and deworming reminders and the guides are for information only and are based on general rules. Always check with your vet. In an emergency, contact a vet straight away.
- We do not verify alerts, danger alerts, sightings or reviews posted by users. Use them with judgement and contact the authorities when there is a real danger.
- We do not verify users' identity. Be careful when meeting someone, and never pay in advance for the return of an animal.
14. Liability
We are liable to you for damage caused by our failure to meet our obligations, within the limits of the law. To the extent the law allows, we are not liable for indirect loss, for loss caused by content posted by other users or by partners, by third-party services failing (for example push or map services), or by events beyond our reasonable control (force majeure). As a hosting service, we are not liable for content posted by users as long as we do not know that it is illegal and, once we become aware of it, we act promptly to remove it or disable access to it (Article 6 of the Digital Services Act).
For paid services, our total liability is limited to the amounts you paid Berry in the 12 months before the event; for free use, to 100 euros. These limits do not apply to damage caused intentionally or through gross negligence, to death or personal injury, or to any other case where the law does not allow liability to be limited. Nothing in the Agreement restricts the rights you have as a consumer under the law.
You are responsible for the content you post and for how you use Berry, including towards third parties harmed by a false alert or an accusation.
15. Suspension and termination
You can stop using Berry at any time by deleting your account under Profile → Delete account or by writing to support@qr-iva.com. Deleting your account cancels any active subscription immediately, with no refund for the rest of the period already paid (unless you are withdrawing within the 14 days or one of the cases in the Subscription and refund terms applies); what happens to your data is explained in the Privacy policy.
We may suspend or close an account, immediately if the situation requires it, if: you seriously or repeatedly breach the Agreement or the Community guidelines; the use of the account endangers other users, animals or the service; we are required to by law or by an authority; or there is a reasonable suspicion of fraud. We tell you the reason unless the law or safety prevents it. If we close your account through no fault of yours, we refund the unused part of any subscription paid in advance.
16. Changes to these terms
We may update the Agreement, for example when we add features or the law changes. We tell you about important changes by email or in the app at least 15 days before they apply and ask you to accept the terms again. If you do not agree, you can cancel your subscription or delete your account before the change takes effect. Changes required by law or needed for safety may apply sooner. The date at the top shows the version in force.
17. Governing law and disputes
The Agreement is governed by Romanian law. If you are a consumer habitually resident in another European Union country, you keep the protection of the mandatory rules of your country.
Please write to us first at support@qr-iva.com; we try to resolve any problem amicably. You can file a complaint with the Romanian National Authority for Consumer Protection (anpc.ro) or use alternative dispute resolution (ADR/SAL). The European online dispute resolution platform (ODR/SOL) closed on 20 July 2025; if you live in another EU country, the European Consumer Centre in your country can also help you. Disputes that are not settled amicably fall within the jurisdiction of the Romanian courts; as a consumer, you may also bring a claim before the courts where you live.
18. General
If a provision of the Agreement is found invalid, the rest remains in force. Not exercising a right is not a waiver of it. We may transfer the Agreement to a company that takes over the Berry business, while respecting your rights. Communications between us are electronic, and our electronic records (acceptances, payments, messages) are proof unless the contrary is shown.
The Romanian version of the Agreement prevails. Translations into other languages are provided for convenience.
In accordance with Article 1203 of the Romanian Civil Code, you confirm that you have read and expressly accept the following clauses: limitation of liability (section 14), suspension and termination (section 15), changes to these terms (section 16), automatic renewal of the subscription and price changes (section 9 and the Subscription and refund terms).
